PIC 4020 of the Migration Regulations applies when applicants provide bogus documents or false/misleading information in a visa application. It addresses a range of issues including:
- Identity issues
- Fake qualifications
- Altered records
- Undisclosed convictions
During the visa application process, the Department may notify an applicant of concerns in respect of bogus documents or false and misleading information by issuing a Request for Information – commonly referred to as a PIC4020 Notice.
The applicant must respond to the specific claims made by the DHA and provide evidence and submissions to address the allegations. This evidence must be submitted within the strict deadlines specified in the Department’s notice – usually within 28 days
The following case study highlights how Interstaff’s strategic expertise helped an employer overcome complex PIC4020 immigration challenges.
The Case:
PIC4020
A restaurant manager’s visa application was flagged under PIC 4020 for allegedly providing bogus work references.
Actions Taken:
- Consulted with applicant and referee to confirm references were genuine.
- Requested additional documents to establish the applicant’s employment history within the business.
- Prepared a detailed submission with supporting declarations.
- Addressed the legislative definition of a ‘bogus document and explained why the work references did not meet that threshold.
- Responded to all Department concerns, demonstrating the authenticity of the evidence.
Outcome:
The submission was successfully prepared and lodged within the Department’s Request for Information deadline.
Interstaff presented a compelling case that verified the applicant’s genuine employment history, effectively addressing the Department’s PIC 4020 concerns.
As a result, the visa was granted, avoiding a visa refusal that would have necessitated review by the Administrative Reviews Tribunal—a process that would have been more complex and administratively burdensome and would have caused significant delays to the employee’s onboarding.
